Serial No. 01 Supplementary List

2. By this petition preferred under Section 528 of the BNSS, the petitioner seeks quashing of the FIR registered with Mawkyrwat Women Police Station being FIR No. 05/2025 dated 30.04.2025 and consequently, the proceeding pending before the leaned Sessions Judge, Mawkyrwat being Session Case No. 08 of 2025.

3. At the outset, learned Addl PP raised a preliminary objection. He submits that the petition has been filed belatedly seeking quashing of the case, which was registered under Sections 329 (3), 118(2) and 109(1) of the BNS after the evidence of the injured was recorded and after 11 witnesses were examined by the prosecution. He submits that the injured i.e., PW3 has clearly supported her case as disclosed in the FIR.

4. In view of the objection raised by the learned Addl PP, learned counsel for the petitioner seeks leave to withdraw the petition.

5. The petition is dismissed only on the premise that the trial has come to a fag end and as such, this court is not inclined to entertain this petition seeking quashing of the case registered under Sections 329 (3), 118(2) and 109(1) of the BNS.

6. Needless to state, that the trial court to conduct the trial on its own merits uninfluenced by the order passed in the aforesaid petition.

7. The petition is disposed of, accordingly.
