After arguing for some time when the Court was not inclined to entertain this petition seeking quashing of the proceeding with the consent of the parties, learned counsel for the petitioner sought leave to withdraw the petition.

The petition is, accordingly disposed of as withdrawn.

Needless to state, that the trial court to conduct the case on its own merits uninfluenced by the withdrawal of this petition.
