4. Learned counsel for the State opposes the prayer for pre-arrest bail and submits that charge sheet in the case at hand has been filed on 23.07.2013 citing the Petitioner as absconder.
5. Per contra, learned counsel for the Petitioner submits that though the Petitioner was all alone available in the village with an ulterior motive he has been shown as an absconder.
6. It is stated at the Bar that the injury suffered is simple in nature.
7. Taking into account the nature of allegations and the lapse of time between the date of occurrence and the present date, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature.
8. If it comes to the fore that the Petitioner has any such criminal antecedent, this order shall not be given effect to.
9. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.
