W.P.(C) No. 27903 of 2026

ODHC010635352026

CORAM:

JUSTICE SASHIKANTA MISHRA

ORDER

11.09.2026

1. This matter is taken up through hybrid mode.

2. Heard learned counsel for the petitioner and learned Addl. Government Advocate for the State.

3. The petitioner filed Mutation Case No. 470 of 2026 before the Addl. Tahasildar, Saharpada for recording of the ROR in his favour on the basis of the Judgment passed by the Addl. District Judge, Keonjhar in RFA No.13/12 of 2020-18. By order dated 11.05.2026, the Additional Tahasildar has quoted the operative portion of the order passed by the Appellate Court and abruptly dropped the case by observing as follows:

“As the case has no merit, hence this case is dropped”

4. It is evident that no reason whatsoever has been cited for dropping the case. Moreover, the Appellate Court having allowed the appeal in favour of the petitioner, prima facie, he had a good ground for seeking correction of the ROR. It is trite law that the revenue authorities are required to record reasons to justify their orders. The impugned order being passed without recording any reason, it is therefore, rendered unsustainable in the eye of law. Basanta Patra .… Petitioner Represented by

5. The writ petition is, therefore, allowed. The impugned order is set aside. The matter is remitted to the Additional Tahasildar, Saharpada for hearing the mutation case afresh and disposing of the same by passing a reasoned order.
