01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.340 of 2026 pending in the Court of learned N.G.N-CUM-J.M.F.C, Rajnagar, Kendrapara, arising out of Rajnagar P.S. Case No.223 of 2026 for commission of offences punishable under Section 137(2) of BNS 2023.
3. Learned counsel for the State submits that since the offence is bailable in nature, the ABLAPL is disposed of as not maintainable.
4. Liberty is given to the Petitioner to renew his prayer in the event he is being implicated for commission of any non-bailable offence.
