CORAM: JUSTICE G. SATAPATHY

DATE OF HEARING & JUDGMENT:11.09.2026(ORAL)

G. Satapathy, J.

1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Tangarpali PS Case No.273 of 2025 corresponding to ST Case No.47/22 of 2026 pending in the file of learned 2nd Additional Sessions Judge, Rourkela, Dist- Sundargarh, for being charge-sheeted for commission of offences punishable U/Ss.111(2)(b)/305(b)/3(5) of BNS, on the main allegation of committing organized crime by stealing the Bolero Vehicle of the informant,

along with co-accused persons in furtherance of their common intention.

2. Heard, Mr. Soumya Ranjan Das, learned counsel for the petitioner and Mr. S.C. Pradhan, learned Additional Public Prosecutor in the matter and perused the record.

3. No doubt the learned Additional Public Prosecutor opposes the bail application of the petitioner for his involvement in 10 cases of similar nature, but fact remains that the stolen Bolero Vehicle was recovered at the instance of co-accused Kanhu Nayak and the present petitioner is implicated in this case on the basis of statement of co-accused. Besides, the petitioner is in custody since 07.01.2026 and in the meantime, charge-sheet has already been submitted. In the aforesaid facts and circumstance and on consideration of materials placed on record and regard being had to the pre-trial detention of the petitioner in custody and taking into account the other circumstances on record in entirety including

the inherent right of the accused-petitioner to be presumed innocent until proven guilty at the trial and lastly, no material being collected to suggest that the petitioner would abscond or pose threat to the witnesses, if released on bail, this Court without expressing any view on merits admits the petitioner to bail.

4. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions except cash surety as deem fit and proper by it with following condition:-

(i) the petitioner shall report attendance before the jurisdictional Police Station once in a fortnight preferably on a Sunday of each month in between 10 A.M. to 12 Noon for six(06) months from the actual date of release from the custody.

5. The IIC of jurisdictional Police Station shall not detain the petitioner unnecessarily after recording his attendance beyond the time as stipulated.

6. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
