ORDER

1. This matter is taken up through hybrid mode.

2. The petitioner has approached this Court with the following prayer:

“It is therefore, prayed that this Hon’ble Court may graciously be pleased to issue rule NISI to the opposite parties and if the opposite parties fail to show cause or shown insufficient cause make the said rule absolute by directing that the Demarcation Case No.84/2023 shall not proceed till disposal of the Consolidation Revision Case No.7 of 2025 pending before the opposite party no.3; And may pass any other appropriate order or orders or direction or directions for the ends of justice; And for this act of kindness, the petitioner as in duty bound shall ever pray.”

3. After hearing learned counsel for the parties at length, this Court is of the view that since consolidation revision is pending, it would not be proper for the Tahasildar to conduct demarcation over the same property. The writ petition is therefore, disposed of directing the Order No. 05

Page 2 of 2. Additional Commissioner of Consolidation and Settlement, Cuttack (opposite party No.7) to dispose of the revision as early as possible, preferably within four weeks from the date of production of certified copy of this order by the petitioner.

4. Till such time, the property shall not be demarcated.
