ORDER

10.09.2026

02.

1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.184 of 2025 pending on the file of learned J.M.F.C., Aul, Kendrapara arising out of Aul P.S. Case No.89 of 2025 for commission of offences punishable under Sections- 126(2)/ 115(2)/ 74/ 75 of BNS, 2023.

3. Admittedly, the Petitioner was before this Court in ABLAPL No.4442 of 2025 which was disposed of on 13.05.2025 considering the submissions that the Investigating Agency has taken recourse to the provisions as contained in Section 35(3) of BNSS.

4. The present application has been filed, inter alia, on the ground that in spite of resorting to 35(3) of BNSS, the Petitioner is facing imminent threat of arrest more particularly since one of the Sections under which the final form has been submitted is triable by the learned Court of Sessions i.e. Section 75 of BNS.

5. Learned counsel for the State opposes the prayer for pre-arrest bail and, on instruction, submits that the charge sheet has been filed showing the Petitioner as not arrested. Hence, the apprehension of the Petitioner is misconceived and also refuses that there is any threat of arrest from the side of the prosecution.

6. Taking into account that one of the Sections is triable by the learned Court of Sessions, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

7. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.

8. Accordingly, the ABLAPL stands disposed of.
