Order No.

ORDER

10.09.2026

01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.774 of 2026 pending on the file of learned S.D.J.M., Bhanjanagar, arising out of Bhanjanagar P.S. Case No.439 of 2026 for commission of offences punishable under Sections 333/115(2)/126(2)/109/74/324(2)/351(3)/3(5) of BNS, 2023.

3. It is submitted that the present Petitioner is not a named accused and so far as the co-accused persons are concerned, it is stated that liberty has been granted to them to surrender and seek for bail by order dated 27.08.2026 passed in ABLAPL No.9779 of 2026 and order dated 19.08.2026 passed in ABLAPL Nos.6048 & 9469 of 2026.

It is stated that taking into account that the Petitioner is not a named accused, he may be protected by pre-arrest bail.

Learned counsel for the State opposes such prayer for pre-arrest bail.

6. During course of hearing, it has come to fore that the Petitioner has seven criminal antecedents. Taking note of the same, this Court is not inclined to enlarge the Petitioner on pre-arrest bail. Considering the fact that the Petitioner is not a named accused, it shall be open for him to surrender and move for bail before the Court in seisin, which shall be considered on its own merit, without being prejudiced by the order passed by this Court. Ground of parity, if urged, may be considered by the learned Court(s) below.

7. The ABLAPL is accordingly disposed of.
