01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case (R) No.1150 of 2026 pending in the Court of learned JMFC (Rural), Cuttack, arising out of Cuttack Sadar P.S. Case No.528 of 2026 for commission of offence punishable under Sections 303(2) and 3(5) of the BNS, 2023, Read with Section 51 of Odisha Minor Mineral Concession Rules, (OMMCR), 2016.
3. Learned counsel for the Petitioner, on instructions, submits that the Investigating Agency has taken recourse to the provision contained under

Section 35(3) of BNSS, as such, there is no apprehension of arrest.
4. Liberty is granted to the Petitioner to renew his prayer, if there is any fresh cause of action.
5. Accordingly, the ABLAPL stands disposed of.
