01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with C.T. Case No.258 of 2026 pending in the Court of learned JMFC, Khariar, arising out of Khariar P.S. Case No.264 of 2026 for commission of offence punishable under Sections 126(2)/ 329(4)/ 117(2)/ 115(2)/ 303(2)/ 109(1)/ 351(2)/ 3(5) of the BNS, 2023.

3. It is submitted by the learned counsel that the named accused person was enlarged on bail by this Court by order dated 18.08.2026 in ABLAPL No.9513 of 2026 and it is further stated that the

Petitioner is not a named accused person and since he is on better footing, he may be protected by pre- arrest bail.

4. Learned counsel for the State opposes such prayer.

5. Considering the nature of allegations and punishment prescribed, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent.

6. If it comes to fore that the Petitioner has any criminal antecedent, this order shall not be effect to.

7. It is further stated that the Petitioner shall cooperate with the ongoing investigation.

8. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
