1. Heard learned counsel for the Petitioners and learned counsel for the State.

2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.1058 of 2026 pending on the file of learned S.D.J.M., Khurda, arising out of Khurda Sadar P.S. Case No.374 of 2026 for commission of offences punishable under Section 109(1)/ 296/ 3(5)/ 351(2) of BNS.

3. It is submitted by the learned counsel that the co-accused similarly circumstanced has since been enlarged on bail by this Court vide order dated 01.09.2026 in ABLAPL No.9904 of 2026 considering

that the injury suffered is simple in nature. And, it is stated that the Petitioner is at all fours with the said co-accused and he has no criminal proclivity. Hence, the Petitioner may be protected by pre-arrest bail.

4. Learned counsel for the State opposes the prayer for pre-arrest bail.

5. Taking into account the nature of allegations and the release of the co-accused, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

6. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

7. Accordingly, the ABLAPL stands disposed of.
