1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. This is an application U/S.483 of BNSS Act by the petitioner for grant of bail in connection with Gangapur PS Case No.281 of 2026 corresponding to GR Case No.1043 of 2026 pending in the Court of learned JMFC, Aska for commission of offences punishable U/Ss. 52(a) of Odisha Excise Act r/w Sec.274/275 of BNS, on the main allegation of in unauthorized possession of 200litres of ID Liquor.

3. Heard, Mr. Gopal Krishna Nayak, learned counsel for the petitioner and Mr. C. Mohanty, learned Additional Public Prosecutor in the matter and perused the record.

4. No doubt the bail application of the petitioner is opposed to by the learned State counsel for the petitioner having three criminal antecedents of similar nature, but the petitioner has voluntarily surrendered to the custody on 31.07.2026, however, he was not apprehended from the spot and in the meantime, substantial part of investigation is already over. Further, there is unlikelihood of conclusion of trial in near future. In the aforesaid facts and circumstances and on consideration of the materials placed on record together with no materials being produced before this Court to suggest the petitioner would abscond or pose threat to the witnesses, if released on bail and the petitioner being not apprehended from the spot, this Court without expressing any view on merit admits the Petitioner to bail.

5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) each with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions except cash surety as deem fit and proper by it.

6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G. Satapathy)
