ORDER

09.09.2026 Order No.

01.

1. This matter is taken up through Hybrid mode.

2. Heard learned counsel for the Petitioner as well as learned counsel for the State. Perused the CRLMC application as well as the prayer made therein.

3. By filing the present application the accused Petitioner has approached this Court with a prayer for direction to the learned trial Court for early conclusion of the trial in T.R. Case No.31/2023, pending in the file of learned Additional Session Judge-cum-Special Judge, Nimapara, which corresponds to Nimapara P.S. Case No.

251/2022.

4. Learned counsel for the Petitioner, at the outset, contended that although the case is of the year 2022, however, several years have passed in the meantime and the trial has not been concluded. In such view of the matter, learned counsel for the Petitioner submitted that the learned Trial Court be directed to expedite the trial and conclude the same as early as possible.

5. Learned counsel for the State, on the other hand, objected to the prayer made in the present application. He further submitted that the Trial Courts have burdening many old cases, therefore, no specific direction should be passed in this case which was registered in the year 2022.

6. Having regard the submissions made by the learned counsels appearing for the respective parties, on a careful examination of the background facts, further taking note of the prayer made in the present application, this Court is not inclined to pass any specific direction fixing any time limit for disposal of the suit. The refusal of this Court to interfere and to grant the relief prayed for in the present application is based on the fact that there are many cases pending before the trial Courts in the State of Odisha. However, while disposing of the present application, this Court grants liberty to the Petitioner to move the learned trial Court for early disposal of the suit. The learned trial Court, subject to convenience as well as the pendency of cases, shall do well to pass necessary orders thereon and, if possible, make every endeavor to dispose of the matter as expeditiously as possible. The parties are directed to cooperate with

the learned trial Court and not to take any unnecessary adjournments.

7. With the aforesaid observation/direction, the CRLMC application stands disposed of.
