ORDER

09.09.2026

01.

1. Heard learned counsel for the respective parties.

2. Instant CRLMP is filed by the petitioner for a direction to the opposite parties, in particular, opposite party No.4 to forthwith register the FIR on the complaint (Annexure-1) and to investigate into the allegations therein with such other reliefs sought for.

3. Mr. Panda, learned counsel for the petitioner submits that in spite of complaint revealing cognizable offences committed by the accused named, no action has been followed. The further submission is that a representation is addressed to opposite party No.3 as per Annnexure-2 but it has not yielded any result and therefore, a direction may perhaps be issued in that regard.

4. Recorded the response of the State.

5. In course of hearing, Mr. Pradhan, learned counsel submits that he has instructions to appear for three of the accused persons named in the complaint, which is objected by

Mr. Panda, learned counsel for the petitioner. At this juncture, this Court is of the view that no intervention is necessary, especially when the FIR is not yet registered on the complaint of the petitioner and therefore, the same is not allowed.

6. Recording the submission of Mr. Behera, learned AGA for the State and since the claim of the petitioner is that the complaint has not been entertained despite the accused persons having committed cognizable offences made out even after a representation addressed to opposite party No.2, this Court is inclined to direct opposite party No.4 to examine each and every aspect of the complaint including territorial jurisdiction and whether any such cognizable offences allegedly committed by the persons named in the complaint and thereafter, to take a decision and appropriate legal action in accordance with law.

7. Hence, it is ordered.

8. In the result, the CRLMP stands disposed of with the direction as aforesaid for compliance by opposite party No.4 soon after receiving a copy of the order.

9. Issue urgent certified copy as per rules.
