ORDER

09.09.2026 Order No.

01.

1. This matter is taken up through Hybrid Mode.

2. Heard learned counsel for the Petitioner as well as learned counsel for the State. Perused the CRLMC application as well as the prayer made therein.

3. By filing the present application, the Appellant in Criminal Appeal No.06 of 2026 pending in the court of learned Sessions Judge, Jajpur has approached this Court with a prayer for early disposal of the appeal.

4. Learned counsel for the Appellant-Petitioner, at the outset, contended that on the basis of a complaint bearing 2(C)CC Case No.16 of 2002 lodged by the complainant, the present criminal proceeding was initiated against the present Petitioner before the

SDJM, Jajpur. He further contended that by virtue of the judgment dated 04.02.2026, the Petitioner has been convicted. Challenging such judgment and order of conviction, the convict-Petitioner has preferred an appeal bearing Criminal Appeal No.06 of 2026.

5. Learned counsel appearing for the Appellant-Petitioner, at the outset, contended since the case is of the year 2002, the same was initiated on the basis of a complaint bearing 2(C)CC Case No.16 of 2002, a direction has been given to the learned Appellate Court to conclude the hearing of the appeal as expeditiously as possible. He further submitted that the Petitioner has been seriously prejudiced that the case is pending for more than two decades.

6. Learned counsel for the State, on the other hand, contended that the appeal was filed only in the year 2026, therefore, no such direction would be given at this stage. Accordingly, the prayer made in the present application was objected to by the learned Additional Government Advocate.

7. Taking into consideration the submissions made by learned counsels appearing for the parties, on a careful examination on the background facts as well as further taking note of the fact that several year-old appeals are pending before the learned Appellate Court, this Court is not in favour of fixing any time limit for disposal of the appeal. Further, taking into consideration the fact that the complaint case is of the year 2002, this Court deems it proper to dispose of the present application by directing the learned Appellate Court to make every endeavour to expedite the hearing of the appeal and to dispose of the same as expeditiously as possible. The appellant-Petitioner is directed to cooperate with the learned trial court and shall not take any unnecessary adjournments.

8. With the aforesaid observations/ directions, the CRLMC application stands disposed of. .
