ORDER

09.09.2026

01.

1. Heard Mr. Das, learned counsel for the petitioner and State.

2. Instant CRLMP is filed by the petitioner for a direction to the opposite parties and in particular, opposite party No.5 to register the FIR on the complaint as per Annexure-1 and for a investigation into the allegation therein in the interest of justice.

3. It is submitted to the Court by Mr. Das, learned counsel that in spite of the complaint revealing commission of cognizable offences by the accused named therein, it has not been followed by any action even after intimation to opposite party No.3 vide Annexure-2 series, hence, the CRLMP.

4. Recorded the submission of Mr. Nayak, learned AGA for the State, according to whom, dispute appears to be civil in nature. Replying to the same, Mr. Das, learned counsel would submit that the accused persons impersonated the petitioner and managed to prepare forged documents and mortgaged the case land and committed such other mischief narrated in the complaint dated 9th August, 2026. Having regard to the submissions as above and the allegations in the complaint, this Court, without expressing anything on merit of the alleged claim, is of the view that opposite party No.5 should be directed to go through the complaint and if in case any cognizable offences alleged to have committed by the accused persons named to take appropriate legal action if required to register FIR and to proceed thereafter in accordance with law.

5. Hence, it is ordered.

6. In the result, the CRLMP stands disposed of with the direction as aforesaid for compliance.

7. Issue urgent certified copy of this order as per rules.

8. A copy of the order be handed over to the State for intimation to opposite party No.5 for early compliance.
