ORDER

09.09.2026 Order No.

01.

1. This matter is taken up through hybrid arrangement.

2. In the present CMP, the Petitioner has challenged the order dated 06.08.2026 passed by the learned Civil Judge (Sr. Divn.), Nabarangpur in C.S. No.67 of 2023, whereby the prayer of the Petitioner to call for the Record Keeper of the Office of the Tahasildar, Tentulikhunti, has been rejected.

3. Heard learned counsel for the Petitioner.

4. Learned counsel for the Petitioner submits that Opposite Party No.1 has instituted C.S. No.67 of 2023 through its power-of- attorney holder, named, Opposite Party No.2/Plaintiff No.2, before the learned Civil Judge (Sr. Divn.), Nabarangpur, seeking Digitally Signed Signed by: LITARAM MURMU Designation: Personal Assistant Reason: Authentication Location: OHC Date: 10-Sep-2026 18:47:43 Signature Not Verified declaration of title over the suit schedule land by way of adverse possession and confirmation of possession.

5. Learned counsel for the Petitioner further contends that the Petitioner had filed a petition dated 01.08.2026 before the learned Civil Judge (Sr. Divn.), Nabarangpur, seeking to summon the Record Keeper of the Office of the Tahasildar, Nabarangpur, to adduce evidence as to why the copy of the document marked as Ext.8 by the Plaintiff had not been supplied to the Petitioner. However, the said petition has been rejected, which is illegal and unsustainable in the eye of law.

6. In view of the above and without expressing any opinion on the merits of the case, this Court is of the considered view that the document marked as Ext.8 is relevant for proper adjudication of the dispute. Accordingly, the present CMP is allowed. The Record Keeper of the Office of the Tahasildar, Nabarangpur is directed to supply a copy of the document marked as Ext.8 to the Petitioner forthwith, in order to enable him to produce the same before the learned trial Court.

7. Accordingly, the CMP is disposed of.
