ORDER
09.09.2026
1. This matter is taken up through hybrid mode.
2. The petitioner has approached this Court with the following prayer:- “In the above facts and circumstances, it is humbly and respectfully prayed that this Hon’ble Court may graciously be pleased:-
i) To admit the writ petition ii)To direct/order the O.P. No.4 (Registrar of Birth & Deaths-cum-Health Officer, Dhenkanal Municipality) to issue Non Availability Certificate (NAC) in favour of the petitioner by accepting the date of birth 18.07.1969 in the HSC Marksheet issued by the Head Master of Sardar Patel High School, Sadashibpur, Dhenkanal. iii)To direct order the O.P. No.5 (CDM & PHO, Dist. HQrs Hospital, Dhenkanal) to search and trace the petitioners birth record on 26.07.1969 or July, 1969 month delivery register and provide the same to the petitioner as soon as practicable or within a time framed by this Hon’ble Court. And may pass any other order/orders as may deem fit and proper. And for this act of kindness, the petitioner shall as in duty bound ever pray.”
3. In course of hearing, Mr. Mohanty, learned counsel appearing for the petitioner draws attention of this Court to a document enclosed under Annexure-3 Series, which is a letter dated Shrinibash Parida .… Petitioner Represented by

Mrs. J. Sahoo, Additional Standing Counsel Order No.
02. 12.06.2024 addressed to the ME and PIO, Dhenkanal Municipality by the Registrar of Birth & Death-cum-Health Officer, Dhenkanal Municipality. According to Mr. Mohanty, this is not in the proper format inasmuch as it does not contain the endorsement „NAC‟, which is the short form of “Non Availability Certificate”.
4. Such being the case, it is for the petitioner to approach the Registrar of Birth & Death-cum-Health Officer, Dhenkanal Municipality for making the necessary endorsement.
5. The Writ Petition is disposed of granting liberty to the petitioner to approach the Registrar of Birth & Death-cum-Health Officer, Dhenkanal Municipality for making necessary endorsement on the aforementioned document.
6. If such motion is made by the petitioner within ten days from today, the Registrar shall consider the same in accordance with law.
