ORDER

09.09.2026

04. 1. Heard learned counsel for the respective parties.

2. Instant revision is filed by the petitioner assailing the impugned order of cognizance dated 29th May, 2025 passed in connection with C.T. Case No.319 of 2025 by the learned J.M.F.C., G. Udayagiri as at Annexure-3 on the grounds stated.

3. Perused the FIR as at Annexure-1 and a copy of the chargesheet i.e. Annexure-2.

4. Mr. Dasparida, learned counsel for the petitioner submits that NBWA is pending execution against the petitioner after the submission of chargesheet i.e. Annexure-2. Mr. Das, learned counsel for opposite party No.2 submits that a case is made out and hence, the order of cognizance has been passed by the learned court below as per Annexure-3 on a satisfaction reached at that the offences under Sections 296/351(2) BNS have been committed by the petitioner.

5. Considering the FIR and the chargesheet as at Annexures-1 & 2 respectively and the submissions of learned counsel for both the sides, this Court is of the view that there is no merit in the revision and hence, the order of cognizance dated 29th May, 2025 at Annexure-3 does not call for any interference. But, at the same time, having regard to the fact that the offences are triable by a Magistrate First Class, this Court is inclined to direct the petitioner to surrender before the learned court below for being released on bail with suitable conditions imposed.

6. Accordingly, it is ordered.

7. In the result, the CRLREV stands dismissed and disposed of, however, with a direction to the petitioner to surrender before the court of the learned J.M.F.C., G. Udayagiri on or before 18th September, 2026 in connection with C.T. Case No.319 of 2025 for being released on bail with suitable conditions as deemed just and proper in the facts and circumstances of the case and until such surrender, there shall be no coercive against him.

8. Issue urgent certified copy as per rules.
