ORDER

08.09.2026

03. 1. Heard learned counsel for the Petitioners and learned counsel for the State.

2. The Petitioners are seeking pre-arrest bail in connection with G.R. case No.513 of 2026, pending on the file of learned J.M.F.C., Niali, arising out of Niali P.S. Case No.530 of 2026, for commission of offences punishable under Sections 54/ 109/ 115(2)/ 126(2)/ 296/ 351(3)/ 3(5) of BNS.

3. In view of the note of the learned Registrar (Judicial) and the officials dealing with the matter, no further order need be passed.

4. Registrar (judicial) is requested to ensure that photographs of the injuries, if filed along with the bail application, the matter shall be placed putting the same in a sealed cover.

5. Learned counsel for the State, while opposing the prayer for pre-arrest bail, submits that though the injury is simple considering the seat of the injury on the head, no leniency ought to be shown.

6. Learned counsel for the Petitioners submits that because of the counter FIR exaggerated allegations have been made.

7. Considering the rival submission, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature.

8. If it comes to the fore that the Petitioners have any such criminal antecedent, this order shall not be given effect to.

9. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

10. It is further directed that the Petitioners shall not in any way try to intimidate the informant and/or her family member.

11. It shall be open to the prosecution as well as informant to seek variance of this order, in case there is any threat perception.
