ORDER

08.09.2026 Order No.

02.

1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. Heard learned counsel for the Petitioner as well as learned counsel for the Private Opposite Party No.2 and learned counsel for the State.

3. By filing the present application the accused-Petitioner in 1CC Case No.157/179 of 2024 pending before the learned S.D.J.M., Baripada has approached this Court with a prayer to quash the order dated 21.03.2025 wherein an NBW has been issued against the present Petitioner.

4. Learned counsel for the Petitioner at the outset contended that the above noted 1CC Case was initiated at the instance of the Opposite Party No.2 for alleged commission of a crime punishable under Section 138 of the N.I. Act. He further submitted that although the Petitioner was appearing before the learned trial Court, however on 21.03.2025 he could not appear due to communication gap with his conducting counsel. As a result an NBW has been issued against the Petitioner by the learned trial Court. He further submitted that the Petitioner is ready and willing to cooperate with the learned trial Court, provided another opportunity is given to the Petitioner.

5. Learned counsel appearing for the Opposite Party No.2, on the other hand, objected to the prayer made in the present application.

6. Considering the submission made by the learned counsels appearing for the Petitioner and the private Opposite Party No.2 and further on a careful examination of the backgrounds facts, the NBW issued vide order dated 21.03.2025 is hereby quashed, subject to the Petitioner paying a cost of Rs.1000/- to the Advocates’ Welfare Fund of Local Bar Association within fifteen days and furnishing money receipt thereof in proof of deposit. It is further directed that the Parties shall cooperate with the learned trial Court for early disposal of the case and they shall not seek any unnecessary adjournment. The learned trial Court shall make every endeavour to dispose of the application as expeditiously as

possible.

7. With the aforesaid observation, the CRLMC application stands disposed of.
