ORDER

08.09.2026

01.

1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with 2(b) CC Case No.12 of 2023 pending on the file of learned S.D.J.M., Padampur, arising out of O.R. Case No.12 of 2023-24 for commission of offences punishable under Sections 21 of OT & OFPT Rule 1980 and Section 56 of OFA, 1972.

3. It is submitted by the learned counsel that the because of the earlier criminal antecedents, the Petitioner is being made a scapegoat in the case at hand and the basis of accusation is on account of the co-accused statement. Hence, he may be protected by pre-arrest bail.

4. Learned counsel for the State opposes the prayer for pre-arrest bail, inter alia, on the ground that the Petitioner has criminal antecedents.

5. Taking into account the nature of allegations in the case at hand and the basis of implication, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

6. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.

7. Accordingly, the ABLAPL stands disposed of.
