(i) direct/order the Opp. Party No.2 to settle the theft claim of the Petitioner's vehicle bearing Regn. OD-09V-1785, Tata LPT 3718 (Truck) vide Claim

(ii) pass such other order(s) or issue direction(s) as may be deemed fit and proper in the bona fide interest of justice.”

4. Mr. Lalatendu Samantaray, learned Senior Counsel appearing for the Petitioner, at the outset, referred to the letter of the Opposite Party No.2 dated 8th June, 2026 wherein the said Opposite Party No.2 has invited objection from the Petitioner within fifteen days from the receipt of that letter, failing which, they have stated that the claim of the Petitioner shall be treated to have been repudiated on the grounds mentioned in that letter. He further contended that pursuant to the aforesaid letter, he has already filed his clarification through his counsel vide letter dated 24.06.2026, at Annexure-6 to the writ petition. However, no decision has been taken as has been assured by the Opposite Party No.2 in his letter dated 8th June, 2026 at Annexure-5. Being aggrieved by the inaction of the Opposite Party No.2, the Petitioner has approached this Court by filing the present writ petition.

5. Taking into consideration the submission made by the learned Senior Counsel appearing for the Petitioner and on a careful examination of the materials on record, further considering the limited nature of the grievance, this Court deems it proper to dispose of the writ petition at the stage of admission by directing the Opposite Party No.2 to consider the case of the Petitioner keeping in view the reply given on 24.06.2026, at Annexure-6, and to take a final decision within a period of four weeks. The final decision so taken by the Opposite Party No.2 be communicated to the Petitioner within ten days from the date of taking such decision.
