1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Nayagarh PS Case No.149 of 2024 corresponding to GR Case No.439 of 2024 pending in the file of learned Sessions Judge, Nayagarh for commission of offences punishable U/Ss. 294/506/302/34 of IPC, on the main allegation of assaulting Jyoti Mahar, a lunatic person to death, along with co-accused persons.
3. Heard, Ms. Bini Mishra, learned counsel for the petitioner and Mr. S.C. Pradhan, learned Additional Public Prosecutor in the matter and perused the record together with the copy of deposition of PWs.1 to 16.
4. Admittedly, the petitioner is in custody since 30.04.2024, but in the meantime, 16 witnesses have already been examined. No doubt the prosecution heavily relies upon the evidence of witnesses Siba Ranjan Singa, Amzadulla Islam, Pabitra Kumar Behera and Priti Prakash Mahanty as eye witnesses to the occurrence, but none of them while being examined as PWs.11, 12, 13 & 15 have testified anything to have seen the occurrence, rather their evidence appear to suggest that when they reached to the spot, one of the accused ran away from the spot. In the aforesaid facts and circumstances and on consideration of the materials placed on record together with the pre-trial detention of the petitioner in custody and trial being not likely to be concluded in near future, this Court without expressing any view on merit admits the petitioner to bail.
5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions except cash surety as deem fit and proper by it.
6. Accordingly, the BLAPL stands disposed of.
7. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
