02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.1296 of 2021 pending on the file of learned Court in seisin arising out of Angul Sadar P.S. Case No.568 of 2021, for commission of offences punishable under Sections 302/147/148/341/149/120(B) of the IPC.
3. Learned counsel for the State opposes such prayer.
4. Taking into account the nature of allegations, charge sheet has been filed, inter alia, under Section 302 of IPC and the rejection of the bail application in respect of the co-accused by order dated 02.02.2022 and 23.04.2024 in ABLAPL Nos.525 and 15777 of 2022 respectively, this Court is not inclined to entertain the application for pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin and moves an application for his release on bail, the same shall be considered on its own merit.
5. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
