CORAM:
THE HON’BLE MR. JUSTICE CHITTARANJAN DASH
Order No.
ORDER
08.09.2026
01.
1. Heard learned counsel for both the Parties.
2. By means of this Application, the Petitioner seeks a direction from this Court for compliance of the order dated 12.01.2022 passed in W.P.(C) No.33565 of 2021.
3. The background facts of this case are that the Petitioner who initially challenged the appointment of Opposite Party No.6, on the ground that his appointment was on the basis of manipulated record was not accepted by the Authority for which the Petitioner moved this Court in W.P.(C) No.33565 of 2021, wherein a Co-ordinate Bench of this Court vide order dated 12.01.2022 disposed the Writ Petition, directed as follows:

Party No.3 to consider the representation dated 07.06.2021, if any pending before him, within a period of eight weeks from the date of production of authenticated copy of this order. It is needless to mention here that the representation of the Petitioner shall be considered and disposed of by passing a speaking and reasoned order. It is made clear that this Court has not expressed any opinion on the merits of the case.”
4. It is submitted by the learned counsel for the Petitioner that, subsequent to the direction issued by this Court, the matter was taken up by the Authority, and an inquiry was conducted in that regard. In the course of the inquiry, it also came to light that the age of Opposite Party No. 6, as recorded in the school admission register, had been manipulated. He further submits that the signature of the Petitioner had also been tampered with. He also submits that although the inquiry was completed in the year 2021, prior to the direction passed by this Court, the Authorities had turned a deaf ear to the matter and failed to comply with the order of this Court.
5. Having heard the learned counsel for the Petitioner and considering the circumstances appearing in the case, though much water has flown into the sea and the person against whom the Petitioner has approached this Court has completed almost thirty
(30) years of service and further there appears several disputed question of facts that needs evidence to be adduced to reach a finality, the Authority is required to look into the grievance of the Petitioner, dispose of the same complying with the direction passed by the coordinate Bench of this Court in accordance with law within a period of three (03) months, and communicate the result thereof to the Petitioner within two (02) weeks thereafter.
6. In view of the above, the Writ Petition is disposed of.
