ORDER
08.09.2026
04. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.2469 of 2025 pending on the file of learned S.D.J.M., Kendrapara, arising out of Marsaghai P.S. Case No.381 of 2025 for commission of offences punishable under Sections 318(4)/296/351(2)/3(5) of BNS, 2023.
3. The allegation against the Petitioners is that taking advantage of blindness of the Informant, they have opened two loan accounts in the name of the Petitioners, out of which they have paid the amount in one account.
4. Considering the manner in which the trust reposed in the Informant by a blind person has been brazenly violated, this Court is not persuaded to enlarge him on pre-arrest bail. Accordingly, the ABLAPL stands rejected. However, it shall be open for the Petitioner to surrender and move for bail before the Court in seisin, which shall be considered on its own merit, without being prejudiced by the order passed by this Court.
5. The ABLAPL is accordingly disposed of.
