ORDER

08.09.2026

02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with the case arising out of Khurda P.S. Case No.281 of 2026 pending on the file of learned S.D.J.M., Khurda for commission of offences punishable under Sections 85/115(2)/296/351(3)/ 3(5) of BNS, 2023.

3. It is submitted that even if the entire prosecution allegation is accepted at its face value, the custodial interrogation of the Petitioner is not warranted. Hence, the petitioner may be protected by pre-arrest bail.

4. Learned counsel for the State and Informant oppose such prayer of pre-arrest bail.

5. The Informant, who is also present in Court, submits that the Petitioner ought not to be released on pre-arrest bail.

6. Considering the rival submissions and on going through the materials on record, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

7. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.

8. The ABLAPL is accordingly disposed of.
