CORAM:

THE HON’BLE MR. JUSTICE CHITTARANJAN DASH

Order No.

ORDER

08.09.2026

01.

1. Heard learned counsel for the Parties.

2. By means of this application, the Petitioner seeks the indulgence of this Court for a direction to the Opp. Party No.4, i.e. the District Sub-Registrar, Bhuban, in the District of Dhenkanal, to accept the instrument presented for registration in accordance with law.

3. In course of the hearing of the application, the Petitioner failed to show that the document was presented in accordance with the prescribed procedure against the allotted slot. Further, there is neither any document on record nor any averment made in the writ application to indicate that the Petitioner had obtained a slot for registration of the instrument.

4. It is obvious that unless the instrument is presented in accordance with the procedure, the incumbent authority i.e. the District Sub-Registrar would not be under obligation to pass any order accepting or refusing the registration of the document.

5. While disposing of the Writ Petition at the stage of admission, therefore, it is observed that the Petitioner, if so advised, may obtain a slot and present the instrument for registration. In such event, the District Sub-Registrar shall consider the same and pass an appropriate order, either accepting or rejecting to admit the document to registration, in accordance with law.
