ORDER

Order No.

03. 07.09.2026

(Through hybrid Mode)

1. This writ petition has been filed with the following prayer: “It is therefore prayed that your lordships may graciously be pleased to admit this writ petition, issue notice to the Opposite party authorities, after hearing both the parties may Issue a Writ of Mandamus, or any other appropriate writ, directing the Respondents (specifically Respondents No. 4 and 5) to immediately verify the physical housing conditions of the Petitioners and include their names in the PMAY-G Beneficiary List / Permanent Wait List (PWL) for immediate allocation of housing funds and may issue a Direction to Opp.

Party No. 2 (District Collector) to make a fresh inquiry into the preparation of the beneficiary list for the Sukal Gram Panchayat under Satyabadi Block Dist. Puri to check for arbitrary exclusions of highly vulnerable candidates. And may Pass an Interim Order directing the Opp. Parties to keep 02 (two) housing slots vacant / reserved under the PMAY-G allocation in the target village during the pendency of this Writ Petition.”

2. Pursuant to order dated 10.08.2026, Mr. Santosh Kumar Dash, learned counsel for the Petitioners submits that he has filed the copy of the ration card of Petitioner No.2-Basanti Swain but the Speed Post receipts indicating that the Petitioners’ representation dated 09.04.2025 has been sent to the Chief Minister, Collector Puri and B.D.O., Satyabadi were not found and could not be filed.

3. The Registry has however not pointed out that the order dated 10.08.2026 has not been fully complied with. The concerned Dealing Assistant should be careful while preparing the office note.

4. Although it is stated in paragraph 6 of the writ petition that the Petitioners had approached the Opposite Party No.4-B.D.O. and Opposite Party No.5-The Panchayat Executive Officer with the detailed written representation and no speaking order has been puspa

passed or steps taken by the authorities, there is no document on record to show that such representation had been sent to the BDO or the PEO.

5. Hence, the writ petition is disposed of permitting the Petitioners to file separate representations/applications before the Opposite Party No.4-B.D.O. and Opposite Party No.5-The Panchayat Executive Officer along with supporting documents within a period of two weeks.

6. It is needless to say that if such representations / applications are filed by 21.09.2026 along with a copy of this order, the Opposite Party No.4-B.D.O. and Opposite Party No.5-The Panchayat Executive Officer will do well to consider the representations / applications and dispose of the same in accordance with law within a period of eight weeks from the date of receipt of the representations and copy of this order.

7. It is made clear that this Court has not gone into the merit of the case of the Petitioners.

8. Issue urgent certified copy on proper application.
