1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. The petitioner by way of this bail application U/S.483 of BNSS has sought for interim bail in connection with G.R.(Spl.) Case No.43 of 2024 corresponding to NCB Crime No.05/CCB/BBSR/2024 dated 19.09.2024 of Intelligence Officer, Narcotics Control Bureau, Sub-Zonal Unit, Bhubaneswar, pending in the file of learned 2nd Addl. District & Sessions Judge, Cuttack, for commission of offences punishable U/Ss.8(c)/20(b)(ii)(C)/28/29 of N.D.P.S. Act, on the main allegation of possessing of

Kgs. of Contraband Ganja.

3. Heard Mr. Soura Chandra Mohapatra, learned Senior Counsel, who is being assisted by Mr. Satya Mohapatra, learned counsel for the petitioner and Mr.

Sudipto Panda, learned C.G.C. and perused the records together with copy of the affidavit annexed with certain medical report, as produced by the learned C.G.C.

4. After having considered the rival submissions upon perusal of the record, it appears that the petitioner has prayed for interim bail by stating inter alia the following in his bail application:-

“8. That on perusal of the said medical document of the mother of the petitioner namely Khetramani Ojha, aged about 70 years, it reveals that she was advised for immediate hospitalization for surgery i.e. Kidney Transplant.”

5. It is pertinent to mention here that the learned C.G.C. has annexed the report of the Doctor with his affidavit and such report of the Doctor reads as under:-

“It is to inform you that patient Khetramani Ojha, 71 years/female was suffering from Diabetes, Hypertension with DKD & dyslipidemia with latest s.cr report (0.9mg/dl, dt.21.07.2026).

After going through records in detail, it is evident that the patient has some renal dysfunction but the question of Kidney Transplantation has never been discussed and not reflected in the document as renal transplantation counselling not required at this stage.”

6. On a careful comparison of the grounds as advanced by the petitioner and the report of the Doctor, it appears both are contradictory to each other, inasmuch as on one hand the petitioner is seeking interim bail for Kidney Transplantation, but on the other hand, the Doctor has stated in his report that renal transplantation counselling is not required at this stage.

7. In view of the aforesaid, this Court does not find any merit in the bail application. Accordingly, the bail application for interim bail stands rejected.
