1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Hinjili PS Case No.551 of 2023 corresponding to ST Case No.145 of 2023 (GR Case No.485 of 2023) pending in the file of learned Addl. Sessions Judge, Chhatrapur, for commission of offences punishable U/Ss.302/201/120- B of IPC, on the main allegation of committing murder of Barsharani Purohit and causing disappearance of evidence by disposing the dead body after entering into conspiracy with co-accused persons.

2. Heard Mr.Jyotirmaya Sahoo, learned counsel for the petitioner and Mr.M.R.Patra, learned Addl. PP in the matter and perused the record including the report submitted by learned Addl. District & Sessions Judge, Chatrapur together with the copy of deposition of PWs. 1 to 39 as produced.

3. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the materials collected in support of the allegation against the petitioner keeping in view the evidence of witnesses examined so far, more particularly that of PWs. 16, 24, 35 & 36 and the role as alleged against the petitioner in the commission of crime and taking into account the other circumstance on record in entirety including the prosecution intention to examine 02 more of witnesses only out of remaining charge sheeted witnesses and trial being likely to be concluded in near future, this Court does not consider it proper to grant bail to the petitioner.

4. Hence, the bail application of the petitioner stands rejected. It is, however, open to the petitioner to renew his prayer for bail, if the trial is not concluded within six months hence or any other justifiable grounds. Accordingly, the BLAPL stands disposed of.
