01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.281 of 2026 pending on the file of learned SDJM, Pallahara, arising out of Talabania P.S. Case No.166 of 2026 for commission of offences punishable under Section 310(4)/ 331(3)/ 317(3) BNS r/w section 25/27 Arms Act.
3. Learned counsel for the State opposes such prayer.
4. Taking into account the nature of allegations, the arrest of the co-accused and criminal proclivity of the Petitioner, this Court is not inclined to entertain the application for pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin and move an application for his release on bail, the same shall be considered on its own merit.
Ground of Parity, if any, may be considered by the learned court(s) below.
5. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
