1. Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.

2. These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Koraput Vigilance PS Case No.11 of 2026 corresponding to VGR Case No.07 of 2026 pending in the file of learned Special Judge, Vigilance, Jeypore for commission of offences punishable U/Ss. 13(2) r/w Sec.12 of the PC Act.

3. The allegation against the petitioners is that the petitioner- Satyanarayan Sethy being an Asst. Executive Engineer, Kotpad Block was found in possession of disproportionate asset to the tune of Rs.2,68,26,306/- which is 268.26% in excess of his known source of income and the allegation against the petitioner Niranjan Sethy is for abetting the principal accused Satyanarayan Sethi by allowing him to acquire property in his name.

4. Heard, Mr. Mihir Kanta Rath, learned counsel for the petitioners in both the bail applications, and Mr. S.K. Das, learned Additional Public Prosecutor for vigilance in the matter and perused the record.

5. Admittedly, the petitioners were taken into custody on 21.06.2026, but till today charge-sheet is yet to be submitted, however, the maximum punishment provided for the offences is imprisonment up-to 10 years. In the aforesaid facts and on consideration of the materials placed on record together with no custodial interrogation being sought for and charge-sheet having not yet been submitted and there being no material to suggest that the petitioner would abscond or pose threat to the witnesses, if released on bail, this Court without expressing any view on merit admits each of the petitioners to bail.

6. Hence, the bail applications of the petitioners stand allowed and the petitioners are allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following conditions:-

(i) the petitioners shall co-operate the further investigation.

7. Accordingly, the BLAPLs stands disposed of.

8. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
