ORDER

02.09.2026

01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with C.T. Case No.2516 of 2025 pending on the file of learned S.D.J.M., Jharsuguda arising out of Jharsuguda P.S. Case No.577 of 2025 for commission of offences punishable under Section 318(4)/319(1)/336(4)/338/340/61(2) of BNS Act read with Section 66(C) /66(D) of Information Technology (Amendment) Act.

3. Learned counsel for the State opposes the prayer for pre-arrest bail.

4. It is submitted that charge sheet has been filed on 11.02.2026

5. On bare perusal of the same, it is seen that the investigation has been kept open to probe the complicity of the other accused persons.

6. It is also brought to the notice of this Court that the Petitioner has criminal proclivity of commission of similar offence.

7. Taking into account the nature of allegations and that the accusation relates to operation of mule accounts and the ramification thereof, this Court is not inclined to entertain the ABLAPL notwithstanding the filing of the charge sheet. However, in the event the Petitioner surrenders before the learned Court in seisin in the aforesaid case and moves an application for his release on bail, the same shall be considered on its own merit.

8. Accordingly, the ABLAPL stands disposed of.
