ORDER

02.09.2026

02. 1. Since both the ABLAPLs relate to the same FIR, they are heard together on the consent of the parties and disposed of by this common order.

2. Heard learned counsel for the Petitioners and learned counsel for the State.

3. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.492 of 2026 pending on the file of learned J.M.F.C., Jaleswar, arising out of Jaleswar P.S. Case No.400 of 2026 for commission of offences punishable under Sections 109(1)/ 115(2)/ 117(2)/ 296/ 3(5)/ 329(3)/ 351(3) of BNS, 2023.

4. It is submitted by the learned counsel for the Petitioners that the genesis of the offence is out of a trivial quarrel regarding the borewell and the allegations happened on the spur of the moment without any pre-meditation and the Petitioners do not have any criminal antecedent. Hence, they may be protected by pre-arrest bail.

5. Learned counsel for the State while opposing the prayer for pre-arrest bail fairly submits that injury suffered is simple.

6. Considering the same, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature.

7. If it comes to the fore that the Petitioners have any such criminal antecedent, this order shall not be given effect to.

8. Additionally it is directed that the Petitioners shall appear before the jurisdictional police station on such date and time to be fixed by the learned Court in seisin once every fortnight or till submission of final form whichever is earlier. Certification of such appearance shall be submitted to the learned Court in seisin.

9. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

10. Accordingly, the ABLAPLs stand disposed of. U.C.C. as per rules.
