ORDER

02.09.2026

1. This matter is taken up through hybrid mode.

2. The petitioner challenges order dated 21.06.2022 passed in OSS Case No.485/2020 by the Member, Board of Revenue.

3. It is submitted that because of mentioning of wrong address of the opposite parties, notice was never served upon them and as a result, they could not participate in the proceeding.

4. Learned counsel for private opposite parties, who were the petitioners in the revision petition, refutes such assertion and submits that the address of the opposite parties in the revision petition was correctly given.

5. Without entering into the controversy, this Court is of the view that this being essentially a private dispute, both the parties need full opportunity to represent their respective cases. Since notice was not served on the petitioners (opposite parties in the revision Order No. 08

Page 2 of 2. petition) for whatever reason, this Court deems it proper to set aside the impugned order and remit the matter to the revisional authority for hearing afresh after granting opportunity of hearing to all parties. To cut short the delay, the parties are directed to appear before the revisional authority on 21st September, 2026 at 10.30 a.m. and produce a copy of this order, whereupon a date of hearing shall be fixed and the matter shall proceed thereafter in accordance with law.

6. This Court further directs that status quo with regard to the suit property as on date shall be maintained till appearance of the parties before the revisional Court. It shall thereafter be open to the parties to pray for appropriate interim relief by filing necessary application before the revisional authority, which, if filed, shall be considered in accordance with law.
