1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Boudh PS Case No.239 of 2018 corresponding to ST Case No.63 of 2023 arising out of CT Case No.617 of 2018(A) pending in the file of learned Sessions Judge, Boudh for commission of offences punishable U/Ss. 399/402 of IPC r/w Sec.4 & 5 of Explosive Substances Act, on the main allegation of congregating in an isolated place, along with co-accused persons being armed with lethal weapons and preparing to commit dacoity in some area.

2. Heard, Mr. Sanjaya Kumar Panigrahi, learned counsel for the petitioner and Mr. M.R. Patra, learned Additional Public Prosecutor in the present matter and perused the record.

3. No doubt, bail to the petitioner has been opposed to by the learned Addl. PP for the criminal antecedents of the petitioner, but this is a bail jump case and the petitioner was earlier granted bail by a co-ordinate Bench of this Court in BLAPL No.8804 of 2019, however, the NBWA was issued against the petitioner on 08.12.2025 when he failed to appear before the trial Court and pursuant thereto, the petitioner was taken into custody on 20.05.2026 on the strength of NBWA and since then, the petitioner is in custody. A comprehensive affidavit has already been filed by the petitioner indicating therein his antecedents. Further, the petitioner must have felt the rigor of law by remaining in custody for flouting the orders of the Court. In the aforesaid circumstances and on consideration of the materials placed on record, since this is a bail jump case, this Court by taking a lenient view admits the petitioner to bail.

4. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper with following condition:-

(i) the petitioner in the course of trial shall attend the trial Court on each date of posting without fail unless his attendance is dispensed with. In case the Petitioner fails without sufficient cause to appear in the Court in accordance with the terms of the bail, the learned trial Court may proceed against the Petitioner for offence U/S.269 of BNS, 2023 in accordance with law.

5. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
