ORDER

02.09.2026

01.

1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with C.T. Case No.1693 of 2024 pending in the Court of learned SDJM, Jharsuguda, arising out of Jharsuguda Sadar P.S. Case No.332 of 2024 for commission of offence punishable under Section 341/ 294/ 323/ 506 of IPC, 1860.

3. It is submitted by the learned counsel for the Petitioners that merely because the Petitioner has criminal antecedents that ought not to deter this Court from considering the allegations on merits in the case at hand. Hence, the Petitioner may be protected by pre-arrest bail.

4. Learned counsel for the State opposes the prayer for pre-arrest bail and submits that the Petitioner has the following criminal antecedents:-

“1. Jharsuguda Sadar PS Case No. 134 Dt. 08.04.2025 u/s 126(2)/115(2)/351(2)/3(5) BNS.

2. Jharsuguda Sadar PS Case No. 318 Dt. 08.06.2024 u/s 341/294/323/506/34 IPC.

5. During the course of hearing, it came to the fore that, in the meanwhile, charge sheet in the case at hand has been submitted and the status of the accused is shown as not arrested since during investigation the Investigating Agency has taken recourse to the provisions as contained in 41(A) of Cr.P.C.

6. In view of the same, since the charge sheet has been filed under Sections 341, 294, 323 and 506 of IPC, this Court does not find any substance in the submissions of the learned counsel for the Petitioner that there is any perceptible threat of arrest.

7. Accordingly, the ABLAPL stands disposed of.

8. Liberty is given to the Petitioner to renew his prayer if there is any fresh cause of action.
