2. The Petitioners in this writ petition, pray for the following relief:

“The petitioners, therefore, pray that Your Lordships would graciously be pleased to admit this writ petition, call for the records and after hearing the parties be pleased to issue writ/writs in the nature of Certiorari and Mandamus directing the Opp Parties to consider the candidature of the Petitioners for admission into the 2nd year B.Tech. course under the Lateral Entry category, against the vacant seats remaining after the 1st year admission process and carried forward to the 2nd year, strictly in accordance with their OJEE-2026 merit/rank, eligibility; AND Pass any other and/or further order as deemed fit and proper under the circumstances of the case.

AND for this act of kindness, the petitioners, as in duty bound, shall forever pray.”

3. It is submitted by Mr. Acharya, learned counsel for the Petitioners, that after the second round of counselling conducted by the OJEE, the residual seats were handed over to the respective Universities and in the instance case to the Odisha University of Technology and Research (OUTR), Bhubaneswar-Opposite Party No.3.

3.1. It is further submitted that on the date of spot selection, i.e., on 14th August, 2026, the Petitioners appeared before Opposite Party No.3 with all their requisite documents. But, they are not allowed to take admission. It is submitted that though vacant seats were available with the OUTR-Opposite Party No.3, the Petitioners were denied admission.

4. Mr. Mishra, learned counsel appearing for the Odisha Joint Entrance Examination (OJEE)-2026 and OUTR- Opposite Party Nos.2 and 3 respectively, submits counselling for lateral entry to B.Tech./ M. Tech., M. Tech. (Part Time), M. Plan and MBA courses was held on 13th August, 2026. Since no vacant seats were available for considering the admission of the Petitioners, their cases could not have been considered on 14th August, 2023, on which date they alleged to have appeared before Opposite Party No.3. He further produces the notice for Spot Admission (2026-27) against vacant seats in LE-B.Tech., M.Tech., and PG Programs, which is taken on record. He also produces a copy of the notice dated 11th August, 2026 showing the vacant seat position for Spot Admission to LE-B. Tech. Programs, which is taken on record.

5. Upon hearing learned counsel for the parties and on perusal of the record, more particularly, the notice dated 11th August, 2026, it clearly discloses that there was no vacant seat for taking admission in OUTR through Lateral Entry. As such, the writ petition merits no consideration.

6. Accordingly, the writ petition stands dismissed.
