ORDER

02.09.2026

02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.1067 of 2026, pending on the file of learned J.M.F.C.(R), Cuttack arising out Cuttack Sadar P.S. Case No.486 of 2026 for commission of offences punishable under Sections 296/ 126(2)/ 109(1)/ 3(5) of BNS, 2023.

3. Learned counsel for the State opposes the prayer for pre-arrest bail inter alia on the ground that the Petitioner has criminal proclivity in as much as he has been cited as an accused in the following cases, though it is stated that the injury suffered is simple:

“i) Cuttack Sadar PS Case No.140 dt.09.03.2020 U/s-294/324/341/506/34 IPC

ii) Cuttack Sadar PS Case No.304, dt.27.05.2023 U/s- 294/323/324/506/34 IPC.”

4. Learned counsel for the Petitioner submits that though the alleged occurrence happened during a marriage procession that ought not to weigh with this Court in considering the prayer for pre-arrest bail.

5. Taking into account the criminal proclivity as noted above and the nature of it and that they are year old, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

6. Additionally it is directed that the Petitioner shall appear before the jurisdictional police station for the next three months on such date and time to be fixed by the learned Court in seisin. Certification of such appearance shall be submitted to the learned Court in seisin.

7. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.

8. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
