ORDER

02.09.2026

01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.952 of 2026 pending on the file of learned JMFC (Cog), Khurda, arising out of Baghamari P.S. Case No.221 of 2026 for commission of offences punishable under Sections 109(1), 115(2), 117(2), 296(b), 3(5) of B.N.S.

3. This is the second journey of the Petitioner to this Court. Earlier the bail application of the present Petitioner was rejected by order dated 07.08.2026 by this Court in ABLAPL No.9095 of 2026, while the other Petitioner was enlarged on bail. While rejecting the bail application of the present Petitioner by order dated 07.08.2026, this Court noted that the injured has suffered a fracture injury.

4. Learned counsel for the State opposes the prayer for pre-arrest bail.

5. Though there is no bar for filing a successive bail application, this Court is not persuaded to hold that there is no change in circumstances.

6. Considering the nature of allegations, this Court is not inclined to entertain the application for pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin and moves an application for his release on bail, the same shall be considered on its own merit.

7. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
