ORDER

01.09.2026 Order No.

02.

1. This matter is taken up through Hybrid mode.

2. Heard learned counsel for the Petitioners as well as learned counsel for the State.

3. Although the Opposite Party No.2 is represented by Ms. Aditi Hota, no counsel on her behalf is present in Court today.

4. Perused the CRLMC application as well as the ground stated therein.

5. By filing the present application under Section 528 of the BNSS, the accused-Petitioner in G.R. Case No.1223 of 2023 pending in the Court of learned J.M.F.C.(O), Bhubaneswar corresponds to Pahala P.S. Case No.262 dated 22.08.2023, which was registered for alleged commission of offence punishable under Section 419/420/120-B/506 of the IPC, has approached this Court with a prayer for quashing of the entire criminal proceeding on the ground that the dispute has been amicably settled through a mediation proceeding held at the Orissa High Court Mediation Centre and the dispute being referred to the Orissa High Court Mediation Centre by a Co-ordinate Bench of this Court in ABLAPL No.1469 of 2023 and ABLAPL No.13467 of 2023.

6. Learned counsel for the Petitioners, at the outset, contended that initially the FIR was lodged at the Pahala Police Station on 22.08.2023 at the instance of the informant namely Jagat Prasad Mishra-Opposite Party No.2. He further contended that that the matter was deferred to the Orissa High Court Mediation Centre for resolution of the dispute amicably through Mediation. He further contended that in the meantime, the dispute has been resolved and in the aforesaid context, learned counsel for the Petitioners referred to the Mediation Report dated 20.05.2024. On perusal of the Mediation Report at Annexure-2 dated 20.05.2024, it appears that the dispute between the Petitioner and the Informant namely Jagat Prasad Mishra has been resolved amicably on compromise and that the Opposite Party No.2-Jagat Prasad Mishra has already received a sum of Rs.45,00,000/- pursuant to the settlement between the parties on 05.03.2024. Accordingly, the learned Mediator has observed that the Mediation has become successful. That Mediation report has also been counter signed by both the parties. In view of the aforesaid development, learned counsel for the Petitioners contended that, since the dispute between the parties has already been amicably settled and the offences in question are compoundable in nature, the pending criminal proceedings ought to be quashed and brought to an end in the larger interest of justice.

7. Learned counsel for the State, on the other hand, contended that on perusal of the record, it appears that the dispute has been resolved amicably with the intervention of the learned Mediator at the Orissa High Court Mediation Centre and such Mediation Report reveals that the mediation has become successful. In such view of the matter, learned counsel for the State contended that in the event, this Court passes any order to secure the ends of justice, there are no objection to be framed.

8. Having regard to the submissions made by learned counsels appearing for both sides, on a careful analysis of the factual background of the present case as well as the subsequent development and further taking note of the mediation report dated 20.05.2024 at Annexure-2, this Court is of the view that the dispute between the parties has already been resolved and that the informant is no more interest to proceed further in this Case. Keeping in view the aforesaid position and the fact that the dispute has been compromised, the entire criminal proceeding arising out of Pahala P.S. Case No.262 dated 22.08.2023 corresponding to G.R. Case No.1223/2023 pending in the court of learned J.M.F.C.(O), Bhubaneswar is hereby quashed. Accordingly, the CRLMC applications stands allowed.
