ORDER

01.09.2026

03. 1. Heard learned counsel for the Petitioner and learned counsel for the State as well as learned counsel for the Informant.

2. The Petitioner is seeking pre-arrest bail in connection with C.T. Case no.470 of 2026 arising out of Remuna P.S. Case No.93 of 2026 pending on the file of learned J.M.F.C., (R), Balasore, for commission of offences punishable under Sections 126(2)/115(2)/ 118(2)/109(1)/296/351(3)/3(5) of the BNS.

3. It is stated that the Petitioner is not a named accused and he does not have any criminal proclivity, yet apprehending arrest, he was before this Court.

4. Learned counsel for the State opposes the prayer for pre-arrest bail and submits that the investigation is at a crucial stage and so at this stage, it cannot be said that no role is ascribed to the Petitioner.

5. Such submission is echoed by the learned counsel for the Informant.

6. Taking into account the rival submission and the progress in the investigation, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

7. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.

8. The ABLAPL is accordingly disposed of.
