ORDER

Order No.

04. 01.09.2026

(Through hybrid Mode)

1. This writ application has been filed with the following prayer: “The petitioners therefore pray that your Lordship would be graciously pleased to admit this Writ petition, call for records, after hearing the parties issue writ/writs in the nature of certiorari/mandamus or any other writ/directions, directing the Additional Chief Secretary, Home Department to consider the petitioners’ objection pertains to approval and selection of post of office bearers of Odisha Ministerial Officers Association and to take decision on the validity of the constitution of such association by providing opportunity of hearing to the parties. And for which act of kindness the petitioner as in duty bound shall ever pray.”

2. There are some typographical errors in the prayer, but Mr. Satapathy, learned counsel for the Petitioner submits that the Petitioner has prayed for issue of a direction to the Additional Chief Secretary, Home Department for consideration of the petitioners’ objection and to provide an opportunity of hearing to them.

3. Mr. S.S. Das, learned counsel has entered appearance on behalf of Opposite Party No.5 and objects to the maintainability of the writ petition stating that since it relates to the election of office bearers of a society, namely, the Odisha Ministerial Officers Association, the writ application is otherwise not maintainable and the prayer also is misconceived.

4. On 18.08.2026, the learned Additional Standing Counsel had prayed for two weeks’ time to obtain instructions.

5. Today, when the matter is taken up, he produces the instructions of the under Secretary to Government in the Department of Home and they have stated that the matter is awaiting a report from the Revenue and DM Department and further course of action will be taken thereafter.

6. Although I find force in the challenge to maintainability of the writ petition, in view of the innocuous nature of order which I propose to pass, it is not necessary to go into the question of maintainability.

7. As the matter is under consideration by the concerned department, the writ petition is disposed of without issuing any direction.

8. I.A. No. 11730 of 2026 also stands disposed of.
