ORDER
01.09.2026
01. 1. Heard learned counsel for the Petitioners and learned counsel for the State.
2. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.737 of 2016 pending on the file of learned J.M.F.C. Chandikhole, arising out of Balichandrapur P.S. Case No.137 of 2016 for commission of offences punishable under Section 323/354-B/506/307/336/379/34 of IPC.
3. It is submitted that the Petitioners were before this Court in ABLAPL No.17051 of 2016 and this Court by order dated 23.02.2017 directed them to surrendering released on bail.
4. It is submitted by the learned counsel for the Petitioners that because of communication gap between the Petitioners and their counsel, they could not avail such order and non-availing of such order is on account of penury.
5. Learned counsel for the State opposes the prayer for pre-arrest bail.
6. Taking into account the nature of allegation, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature and nature of injury.
7. If it comes to the fore that the injured has suffered any grievous injury and the Petitioners have any such criminal antecedent, this order shall not be given effect to.
8. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.
9. Accordingly, the ABLAPL stands disposed of.
10. U.C.C. as per rules.
