ORDER

01.09.2026

01. 1. Heard learned counsel for the Petitioners and learned counsel for the State.

2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.372 of 2023 pending on the file of learned JMFC, Nimapara, arising out of Astaranga P.S. Case No.69 of 2023 for commission of offences punishable under Section 341/ 294/ 323/ 307/ 379/ 34 of IPC.

3. The Petitioners were before this Court in ABLAPL No.8853 of 2026 and by order dated 04.08.2026, this Court had granted them to surrender and be released on pre-arrest bail subject to verification of nature of injury.

4. It is submitted by the learned counsel that since the injury is grievous in nature, the Petitioners have filed this application.

5. Learned counsel for the State at the outset opposes the prayer for pre-arrest bail, inter alia, on the ground that there is no change in circumstance. Hence, the ABLAPL is likely to be rejected on the said ground.

6. During the course of submission, learned counsel for the Petitioners submits that earlier it could not be brought to the notice of this Court that the injury in question is not attributable to the Petitioners and the co-accused persons Prakash Parida, Ramesh Parida and Nirupama Parida respectively against whom the overt act is attributed, have already been released on bail after being taken into custody on 15.03.2024, 04.04.2024, 15.05.2026 respectively. Hence, on the said count, the Petitioners seek release on bail.

7. Learned counsel for the State submits that taking into account the nature of allegations and the F.I.R. has been instituted, inter alia, under Section 34 of IPC, the plea of segregation as being placed into service to seek pre-arrest bail, ought not to weigh with this Court.

8. Considering the rival submission, taking into account the release of the co-accused against whom the overt act is attributed and that the Petitioner No.2 is a lady and though the Petitioners have no criminal proclivity, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification criminal antecedent.

9. If it comes to fore that the Petitioners have any criminal antecedent, this order shall not be given effect to.

10. It is further stated that the Petitioners shall cooperate with the ongoing investigation.

11. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
