ORDER
31.08.2026
01.
1. Heard learned counsel for the Petitioners and learned counsel for the State.
2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.718 of 2026 pending on the file of learned J.M.F.C, Pipili, Puri arising out of Pipili P. S. Case No.513 of 2026 for commission of offences punishable under Sections 126(2)/ 115(2)/ 117(2) /296/ 303(2)/ 324(4)/ 351(2)/ 3(5) of BNS, 2023.
3. It is submitted by the learned counsel that the origin of being implicated in the case at hand is on account of the lis pending in this Court in the form of WP(C) No.6702 of 2023 at the behest of the
Petitioners in which interim orders have been passed protecting their interest being miffed by that the present FIR has been instituted to wriggle out of the accusation in the counter FIR which is also on record which is evidently earlier in point of time. Hence, the Petitioners may be protected by pre- arrest bail.
4. Learned counsel for the State opposes the prayer for pre-arrest bail.
5. Taking into account the nature of allegations and the punishment prescribed, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.
6. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.
7. Accordingly, the ABLAPL stands disposed of.
