ORDER

31.08.2026

02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.512 of 2026 pending on the file of learned JMFC(O), Bhubaneswar arising out of Balipatna P.S. case. No.94 of 2026, for commission of offences punishable under Sections 296/115(2)/126(2)/351(2)/3(5) of BNS.

3. During the course of hearing, learned counsel for the State submits that because of the nature of the injury, the Petitioner is found guilty of commission of offence under Section 109 of BNS and he also refers to the injury report of the injured- Rabindra Pal, which indicates that he has suffered grievous injury and on going through the statement of the injured, it is seen that injury corresponds to the statement.

4. Considering the same, this Court is not inclined to entertain the application for pre- arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin and move an application for his release on bail, the same shall be considered on its own merit.

5. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
